Constitutional Court of Austria

The Constitutional Court stands in the centre of Vienna, a modern court building that houses Austria’s highest tribunal for constitutional matters. It reviews whether laws and ordinances comply with the constitution, resolves disputes between courts and government bodies, and rules on liability claims against the state. Fourteen judges and six substitutes decide cases, though most work happens in smaller panels rather than full sessions. The court’s powers are unusually broad for Europe. It can strike down unconstitutional laws, delay their effects with grace periods of up to eighteen months, and even make decisions retroactive when necessary. It also resolves demarcation conflicts between federal and provincial authorities, sometimes before disputes escalate. Christoph Grabenwarter leads the court as its president. Visitors find a quiet, academic atmosphere inside. The court rarely holds public hearings, and most rulings are delivered in writing after closed deliberations. The building itself is functional rather than grand, reflecting the court’s restrained role in Austrian governance. Outside, the surrounding streets lead to the grand Ringstrasse, linking the court to the city’s historic institutions.
